Seller Terms and Conditions

1. Introduction

These Seller Terms and Conditions ("Terms") govern your use of the BabyGoods platform ("Platform") as a seller. By registering as a seller on our Platform, you agree to be bound by these Terms. Please read them carefully.

BabyGoods is a marketplace that connects sellers of used baby goods with potential buyers in Kenya. We provide the platform for these connections but are not a party to any transaction between users.

2. Seller Eligibility

To become a seller on BabyGoods, you must:

• Be at least 18 years of age
• Have a valid phone number and email address
• Create a BabyGoods account and provide accurate information
• Agree to these Terms and our general Terms and Conditions

3. Listing Requirements

When creating listings on BabyGoods, you agree to:

• Provide accurate and complete information about the items you are selling
• Upload clear photographs that accurately represent the condition of your items
• Set reasonable prices that reflect the condition and market value of your items
• Only list items that you legally own and have the right to sell
• Only list items that are in good, clean condition and meet safety standards
• Not list any prohibited items (see Section 4)

4. Prohibited Items

The following items are prohibited from being listed on BabyGoods:

• Recalled items or items that do not meet current safety standards
• Used breast pumps, pacifiers, bottle nipples, or other personal hygiene items
• Car seats that are more than 7 years old or have been in an accident
• Cribs manufactured before June 2011 (when new safety standards were implemented)
• Items with significant damage, stains, or missing parts
• Counterfeit or replica products
• Prescription medications or medical devices
• Any items prohibited by Kenyan law

BabyGoods reserves the right to remove any listing that violates these prohibitions or that we determine, in our sole discretion, is inappropriate for our Platform.

5. Transactions and Payments

BabyGoods is a platform that facilitates connections between buyers and sellers. We do not:

• Take possession of items being sold
• Process payments between buyers and sellers
• Guarantee transactions or resolve disputes between users

As a seller, you are responsible for:

• Responding to offers and viewing requests in a timely manner
• Arranging safe meeting locations for transactions
• Verifying payment before transferring ownership of items
• Ensuring the item matches the description provided in your listing

6. Fees

Currently, BabyGoods does not charge listing fees or commissions on sales. However, we reserve the right to introduce fees in the future with appropriate notice to our users.

7. Seller Conduct

As a seller on BabyGoods, you agree to:

• Communicate respectfully with potential buyers
• Respond to inquiries, offers, and viewing requests within a reasonable timeframe
• Honor commitments made to buyers
• Meet buyers in safe, public locations when possible
• Accurately represent yourself and your items
• Not engage in price manipulation or deceptive practices
• Not harass, discriminate against, or otherwise mistreat other users

8. Account Suspension and Termination

BabyGoods reserves the right to suspend or terminate your seller account if:

• You violate these Terms or our general Terms and Conditions
• We receive multiple complaints about your conduct or listings
• We suspect fraudulent or illegal activity
• You have not used your account for an extended period

If your account is suspended or terminated, you may lose access to your listing history and other account information.

9. Liability Limitations

BabyGoods is not liable for:

• Disputes between users
• The quality, safety, or legality of items listed
• The accuracy of listings
• The ability of buyers to complete transactions
• Any losses or damages resulting from transactions conducted through our Platform

10. Indemnification

You agree to indemnify and hold harmless BabyGoods, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of another.

11. Changes to Terms

BabyGoods reserves the right to modify these Terms at any time. We will provide notice of significant changes through the Platform or via email. Your continued use of the Platform after such modifications constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of Kenya. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of Kenya.
